Terms and Conditions (T&C)

1. Scope of Application

These Terms and Conditions (T&C) govern the contractual relationship between FMSB GmbH, Sihleggstrasse 23, 8832 Wollerau (hereinafter “ExcerptsService.ch”) and the users of the website and service platform “ExcerptsService.ch” (hereinafter collectively the “Users” and the “Platform”). These T&C apply to all use of the Platform and to all services offered by ExcerptsService.ch in connection with the Platform, unless explicitly agreed otherwise.

FMSB GmbH is the company operating under the brand name “ExcerptsService.ch” and managing the Platform.

ExcerptsService.ch offers the digital processing of criminal record extracts, certificates, forms, and other documents (hereinafter collectively the “Documents”). ExcerptsService.ch does not create these Documents but enables Users to obtain them in digital or electronic form. ExcerptsService.ch acts on behalf of and in the interest of the Users.

ExcerptsService.ch, operated by FMSB GmbH, allows Users to conveniently order criminal record extracts. This service enables Users to complete the entire ordering process online, eliminating the need for printing or visiting a postal office. With a 100% digital ordering process, Users save time. This service incurs an additional service fee beyond the cost of traditional ordering methods.

2. Contractual Relationship

The contractual relationship between FMSB GmbH and each User is established:

by registering for a user account; or
by placing an order without registering for a user account.

The contractual relationship terminates automatically with the deletion of the user account or upon delivery of the ordered Documents. The relationship may also be terminated at any time with immediate effect via email to info@auszugsdienst.ch (with receipt confirmation).

3. Services Provided by ExcerptsService.ch

3.1 General Services

The Platform is exclusively available to natural persons. Users are not entitled to continuous availability of the Platform or to specific functionalities, content, or services. ExcerptsService.ch reserves the right to modify, limit, expand, or discontinue the Platform at any time without notice.

ExcerptsService.ch does not create the Documents and cannot guarantee continuous availability. Users are responsible for their own data backup.

3.2 Paid Services

ExcerptsService.ch may establish additional contractual agreements for paid services. In the event of discrepancies, these additional agreements shall prevail over the T&C.

3.3 Rejections and Refunds

Orders may be rejected for reasons including:

Incorrect personal information (first and last names not matching ID);
Signature that does not match the one on the ID;
Invalid or expired ID.

A fee of CHF 6.00 will be charged for rejections. Refunds are subject to a handling fee of CHF 6.00.

3.4 Newsletter

Users agree to receive a newsletter from ExcerptsService.ch with similar offers. The subscription can be canceled in any email.

4. Intellectual Property and Right of Use

4.1 Intellectual Property Rights

All rights related to the Platform—including copyrights, company rights, know-how, trademarks, software, and information—are exclusively owned by ExcerptsService.ch and/or authorized third parties. No rights are transferred to Users unless explicitly granted.

4.2 Right of Use

By placing an order, Users authorize ExcerptsService.ch to act on their behalf, for instance, to request a criminal record extract. Each individual order is binding.

ExcerptsService.ch may exclude or block Users from use at any time without notice, particularly if there is a suspicion of abusive or unlawful use.

5. User Obligations

Users must keep their account access data confidential and provide correct and complete information. They are responsible for the technical requirements necessary to use the Platform and must report any misuse.

6. Warranty, Liability, and Indemnification

ExcerptsService.ch provides no warranties regarding the Platform. Use of the Platform is at the User’s own risk and responsibility.

ExcerptsService.ch disclaims all liability for direct and indirect damages related to the use of the Platform. This liability exclusion does not apply to damages caused intentionally or by gross negligence by ExcerptsService.ch. No guarantee is provided for timely delivery of Documents; average processing time is approximately 7-14 working days.

Users are obliged to indemnify ExcerptsService.ch fully for any third-party claims related to the Platform.

7. Final Provisions

ExcerptsService.ch reserves the right to modify these T&C. The current version is available on the Platform. The exclusive place of jurisdiction is at the registered office of FMSB GmbH, subject to Swiss law.
